Can I Violate A Trademark With My Domain Name?

Category: FAQ   Time: 2010-01-20   Tags: , , , ,

I just called the US Trademark Center and could not get an answer. @@ Was advised to call an attorney and I do not have the $.
So my domain name is abc123.com
and my DBA is abc123.com
If someone decided to trademark the phrase “abc123″ could I get in trouble even though my DBA is abc123.com (with the .com added could I get in trouble)

No. If someone decided to trademark abc123, with yours being abc123.com; they are two totally different entities/trademarks. There would be no discrepancy. Most likely, if the one who went & trademarked the phrase abc123 became very successful & profitable, the abc123 trade marker would just simply buy the domain from you.
