Does This Constitute Domain Name Infringement?

I have a site that I want to move to a .com domain, but there is a site that has the exact name with a .info. For example, say there is a site named website.info, and I name mine website.com. Is this at all an infringement on domain rights? Please explain why or why not. Thank you!

    If the domain name is available
    there is no infringement
    who ever has the .info
    needs to register .com .net etc to
    secure them
    otherwise they are up for grabs

    No. You can go ahead and register, I have registered http://www.desktops4u.info where as .com is taken by someone else. There is nothing wrong in it.
