For a sole proprietorship, DBA or partnership you will need to register with the County Clerk.  For a limited liability company, limited partnership, or corporation, you will need to register with the Secretary of the State.  You need to register a business in order to report taxes to the IRS (make sure you file the correct IRS forms when registering your business as well).  Failure to do so is against the law, and incurs substantial consequences.  Contact your County Clerk or Secretary of the State for specific information, they are there to help you.  You might also want to consider locating a small business assistance center near you, which can help with creating a business plan, as well as registering, marketing and operating your business.  Their advice is normally free.  If you do not plan on starting the business right away, you can usually reserve a business name with the county or state for a minimal fee.  I hope this helped.
