Who Owns A Domain Name If A Designer Stops Working On The Website?

We asked a designer to build our website, and he acquired domain names for it. He was since relieved of his duties, but the domains are registered in his name. We’ve since launched the business and he is refusing to turn over the domains to us. What are our options, aside from the costly WIPO/NAF procedures? Can we sue in small claims? We are in Wisconsin.

    Did you sign a contract? if so that may help you. Unless otherwise stated your ex-Designer would own the Domain. Depending on how you parted company, they may be willing to sell it back to you, or failing that it’s the WIPO/NAF i’m affrad.

    This happens too often. You have a legal problem… You seriously messed up by letting him register them. If you have someone go buy a car on your behalf, would you let them title it in your name? That’s what you did here. If he won’t turn them over willingly, your only choice is to go after him through the proper channels. And to win, you better be able to 1) be able to prove that he bought them in your name and was paid for it and/or 2) have enough money to outlast him in any long drawn out court battle (which winning will be based on part 1 unless you can out spend him to make him give up).
